As of late 2024, only\u00a0<strong>2 out of 34 judges<\/strong>\u00a0(~6%) are women.<\/li>\n<li><strong>High Courts (HCs):<\/strong>\u00a0Women constitute only about\u00a0<strong>13.3%<\/strong>\u00a0of all judges (113 out of 850 judges) across the 25 HCs.\u00a0<strong>5 HCs have no woman judge<\/strong>\u00a0at all.<\/li>\n<li><strong>Subordinate Judiciary:<\/strong>\u00a0Representation is better at around\u00a0<strong>31%<\/strong>, but this pipeline leaks significantly before reaching the HCs and SC.<\/li>\n<li><strong>Global Comparison:<\/strong>\u00a0Countries like the\u00a0<strong>USA (34%), UK (35%), and Canada (44%)<\/strong>\u00a0have significantly higher representation of women in their apex courts.<\/li>\n<\/ul>\n<p><strong>\u00a0<\/strong><strong>Significance of Gender Equity in Judiciary<\/strong><\/p>\n<ul>\n<li><strong>Diverse Perspectives:<\/strong>\u00a0Ensures more holistic and empathetic interpretation of laws, especially in cases involving sexual violence, dowry, and matrimonial disputes.<\/li>\n<li><strong>Legitimacy and Trust:<\/strong>\u00a0A judiciary that reflects the society it serves enhances public confidence in the justice delivery system.<\/li>\n<li><strong>Role Modelling:<\/strong>\u00a0Women judges serve as powerful role models, inspiring more women to enter and persist in the legal profession.<\/li>\n<\/ul>\n<p><strong>\u00a0<\/strong><strong>Hurdles &amp; The Way Forward<\/strong><\/p>\n<ul>\n<li><strong>Structural Barriers:<\/strong>\u00a0Unconscious bias in\u00a0<strong>collegium deliberations<\/strong>, a lack of transparent criteria, and the &#8220;old boys&#8217; club&#8221; network.<\/li>\n<li><strong>Societal Factors:<\/strong>\u00a0Deep-rooted patriarchy and the &#8220;double burden&#8221; of professional and familial responsibilities.<\/li>\n<li><strong>The Way Forward:<\/strong>\n<ul>\n<li><strong>Formal Policy for Diversity:<\/strong>\u00a0The collegium must institutionalize a transparent and equitable appointment policy.<\/li>\n<li><strong>Strengthen the Pipeline:<\/strong>\u00a0Address attrition by providing robust infrastructural support (creches, flexible hours) and strict enforcement of the\u00a0<strong>POSH Act<\/strong>\u00a0in court premises.<\/li>\n<li><strong>All India Judicial Service (AIJS):<\/strong> If implemented with diversity quotas, it could be a potential game-changer.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>The Road to Gender Equity in Judiciary GS Paper II \u2013 Governance &amp;
